NYC Energy Codes You Need To Be Aware Of

LL84 (Local Law 84)

This NYC energy code was approved in 2009 by the New York City Council to increase the energy efficiency of buildings. This is for owners who have a building with more than an area of fifty thousand square feet.

For LL84, you need to use the Portfolio Manager tool to benchmark and report. During benchmarking, data such as energy usage, building size, and occupancy are collected. The Portfolio Manager Tool then evaluates this information to determine the building’s energy efficiency using the standardized energy use intensity (EUI) metric. You need to submit this by May 1st every year. 

Local Law 87(LL87)

You need to submit a report about energy efficiency if your building is over the prescribed size. The EER should contain Retro-Commissioning measures and Energy Audit outcomes to authenticate how energy-consumption systems inside a building operate. This Energy Efficiency Report needs to be submitted every ten years. 

Local Law 88 (LL88)

It was created in 2009 and was expanded through Local Laws 132 and 134 of 2016. This code applies to both –

• Residential
• Non-residential buildings 

They must have an area greater than 25,000 sq. feet. It says that such properties must upgrade their lighting systems to meet the New York City Energy Conservation Code standards by 2025. It aims to enhance sustainability and reduce energy consumption in large buildings. The LL88 requires owners of non-residential buildings to install electrical sub-meters for each large tenant space that is over 5,000 sqft.

Local Law 95

The Climate Mobilization Act introduced new laws to combat environmental threats. This Act contains a number of resolutions and bills, one of which is Local Law 95. According to this energy code, building owners should showcase energy efficiency letter grades at their entrances. Established in 2009 and expanded by Local Laws 132 and 134 in 2016, NYC energy regulations require commercial buildings over 25,000 square feet to update their lighting systems by 2025 to meet the New York City Energy Conservation Code, aiming to promote sustainability and reduce energy usage.

Local Law 97 

This rule states that if a building goes over the CO₂ limit and emits each ton of CO₂ past the specified threshold, for compliance with regulations will face a penalty charge of $268 per ton of emissions. Additionally LL97 requires buildings with a floor area than 25 000 feet to follow updated energy savings regulations and rules on reducing greenhouse gas emissions. Moreover, the regulation states that by 2050, the largest buildings in New York City must cut their emissions by 40% by 2030 and further reduce emissions by 80% by 2050.   

Local Regulation 133

New York City energy regulations require buildings between 25,000 and 50,000 square feet to report their energy and water usage annually, following LL84 guidelines. Building owners can use Energy STAR Portfolio Manager to generate and submit benchmark reports.
